The Fair Credit Reporting Act (FCRA) governs how consumers’ credit information can be used and shared. Specifically, it empowers consumers to take legal action if a credit reporting agency reports inaccurate information about them, including old debts or debts that belong to another individual. 

If a telemarketing call violates the TCPA (Telephone Consumer Protection Act) it may be illegal. The TCPA prohibits robocalls, or calls that use autodialing or prerecorded voice messages to cellphones. It also prohibits calls that rely on prerecorded messages to residential phone lines that do not have a relationship with the business, as well as any phone number that is on the do-not-call registry. Calls made before 8 a.m. and after 9 p.m.

Mass arbitration is when consumers or employees file arbitration claims against the relevant organization or company alleging the same issue at the same time. This helps demand action from the defendant (the potentially responsible party) as it makes it incredibly difficult for them to ignore the issue at hand. Many times these companies have tried to limit legal action and prevent consumers from filing class action lawsuits by slipping arbitration waivers into their terms of agreement. Mass arbitration is a way to help balance the scales of power once more.

A class action lawsuit allows large groups of individuals similarly affected by the same issue to file one lawsuit against the relevant company or entity that is potentially responsible. This is typically more efficient and cost-effective than filing multiple individual lawsuits as consumers and other plaintiff groups can share legal resources and evidence.
